Chapter 7

• Chapter 7 Bankruptcy gives an individual a new start by eliminating all their non-secured debts subject to a few exceptions like taxes, alimony, and student loans.  Chapter 7 is only an option for those debtors who have no income or income less than their State median income.

 Chapter 13

• Chapter 13 Bankruptcy is an option for individuals with earned income above their State median income.  Chapter 13 allows a debtor to create a 3 or 5 year repayment plan of all their debts which assist the debtor with lower payments so that they can get back on their feet.
